Notifying the defendant is the responsibility of the person filing the notice, this may be an individual acting alone, solicitors or the courts involved. In this age of technology-dependent communication, a phone call or email is not sufficient to notify them of proceedings and why a process server must be appointed. Defendants must personally be notified that actions are being taken against them, according to the law. However, due to legal requirements, only certain individuals are allowed to serve these notices. The individuals that fill this role are called process servers.
A process server at Dion International can provide a serving process on all legal documents such as Statutory Demands, Winding-up Petitions, Claim Forms, Court Orders and divorce petitions. We will provide you with a Certificate of Service, a Statement of Service or a Sworn Affidavit (at an additional cost) confirming the date and time the documents were served and this is usually lodged with the court prior to the hearing.
If a process server is unable to deliver the notice to the subject, they may also utilise a “substituted service.” This means that the process server instead delivers the notification to another legal adult resident of the household where the subject resides, with the understanding that the substitute will notify the subject. Yes, A report can be provided with photographs and a section of writing explaining what has occurred, however, usually an affidavit, statement or certificate of service will be the only requirement for most.
Instructions cannot be cancelled or rescheduled, we have process servers in place to undertake the work and their days must be organised in advance and therefore payment of 50% would still be required for any cancellations within 24hrs.
